When a federal court makes a ruling called a "holding"  it is said to be common law, so I would say that the common law derives from the will of a federal judge or court.  Does  a federal court determine the will of mankind?  It can't because it is a fiction.  So that must be common law within the realm of a fiction.

  I CAN"T HEAR A FICTION.  I am a Man.  Unlike things ought not to be joined.

The common law of Men is custom and usage, traditions.
