Would anyone care to expound on the "Special Mention of the Treaty of Peace" in Lieber Code Article 2: "Martial law does not cease during the hostile occupation, except by special proclamation, ordered by the commander-in-chief, or by special mention in the treaty of peace concluding the war, when the occupation of a place or territory continues beyond the conclusion of peace as one of the conditions of the same."
Could "THE" in that quote^ be pointing to a specific treaty, i.e. the Treaty of Ghent 1814? Or perhaps another Treaty? Or would it be only be the treaty made to conclude the hostile occupation?
I am drafting a document to CLAIM OF NEUTRAL FOREIGN STATUS and thinking to do that with my own rough draft version of "A SPECIAL TREATY OF PEACE" by citing the ICCP and the DECLARATION OF THE INTERNATIONAL RIGHTS AND DUTIES OF THE INDIVIDUAL using an important excerpt "that every individual has the right to live under a system of free enterprise, free from forced labor, from irresponsible private powers, from arbitrary public authorities and from unregulated monopolies". Any constructive criticism would be appreciated on what I have so far:
"For the maintenance of the International Public Order and Safety, this claim of NEUTRAL FOREIGN STATUS by a SPECIAL TREATY OF PEACE is to give notice that Gentle-Firm: Strength is emerging and claiming her right to protection under international law during and after the changes in status, classification and completion orders are processed to correct both public and private records.
As outlined in the Hague Treaties, the Lieber Code and the JAG Army Manuals on the Law of Belligerent Occupation, it is evidenced from a strict legal sense no proclamation was necessary of military occupation and such occupation was provisional implying that the sovereignty of the occupied enemy territory was not vested in the occupying power. Subjugation implied only a transfer of sovereignty and return transfer is herewith affected by this Special Treaty of Peace made by Gentle-Firm: Strength, a peacemaker and sojourner in service to the Divine Providence.
By this proclamation of a Special Treaty of Peace, a claim of lawful standing is set forth in order to state a claim upon which relief can be granted. This NEUTRAL FOREIGN STATUS or standing in honor is herewith claimed as a peaceful means to settle conflicts. Peace cannot be attained without equal standing. With equal standing comes full disclosure. Equality is equity."
